Bianchi Founder Edition Privacy Policy

PRIVACY NOTICE


F.I.V. E. Bianchi S.p.A. processes personal data (hereinafter also referred to as the “Data” or “Personal Data”) in accordance with Regulation (EU) 2016/679 (“GDPR”) and any other applicable data protection legislation, as set out in this privacy notice.

1. Data Controller


The Data Controller of your Personal Data is F.I.V. E. Bianchi S.p.A., with registered office at Via delle Battaglie no. 5 – 24047 Treviglio (BG), Tax Code and Companies Register number 0022943016000229430160, VAT no. 01897810162, e-mail: privacy@bianchi.com (hereinafter also “Bianchi” or the “Controller”).

2. Personal Data

Bianchi will process—both manually and by automated means—the Data strictly necessary to allow you to register for the Founder Edition and to benefit from the advantages connected to such registration. 

Registration will allow you to receive updates and be contacted by Bianchi regarding the Founder Edition bike model and, if applicable, to be put in touch with the nearest Bianchi retailer for purchase. In particular, Bianchi will process identifying and contact data such as your full name, email address, nationality, as provided in the registration form.

Bianchi may also provide you with updates on events and initiatives related to the Founder Edition. If you express your interest in taking part in such events or initiatives, Bianchi may collect additional Personal Data necessary to enable your participation. By way of example, Bianchi may collect identification data in order to make the required event bookings and share such data with third parties involved in the organisation of the events.

3. Purpose and Legal Basis for Processing

Bianchi will process your Personal Data for the purposes and on the legal bases set out below:

a) To allow you to participate in the Founder Edition and to the related services and initiatives, based on the contractual legal basis pursuant to Article 6(1)(b) of the GDPR;

b) To send you information and commercial communications, newsletters and/or market research regarding Bianchi’s products and/or products of Bianchi’s commercial partners, such as promotions (including discount vouchers) through automated means (e.g., email), without sharing your data with third parties, only where you have given your informed, free, specific, and unambiguous consent pursuant to Article 6(1)(a) of the GDPR.

4. Mandatory or Optional Nature of Data Provision and Consequences of Refusal

Providing your Data for the purpose described under Section 3(a) is mandatory: failure to provide it will prevent you from participating in the Founder Edition. 

Providing your Data for the purpose described under Section 3(b) is optional. If you don’t wish to consent to this processing, you can refrain from flagging the second consent box, that states “I consent to receive marketing information and commercial communications, newsletters, and/or market research on Bianchi products and/or products from Bianchi’s commercial partners via automated tools (e.g., e-mail), without data sharing with third parties”. However, please note that you have the right to withdraw your consent at any time, without affecting the lawfulness of the processing based on consent prior to its withdrawal. In particular, you may withdraw consent by clicking the “unsubscribe” link at the bottom of any communication and/or by contacting Bianchi using the contact details provided in this notice.

5. Retention Period of Personal Data

Your Data will be stored for the time strictly necessary to achieve the purposes outlined in Section 3 above.

Specifically, Personal Data processed for the purpose under Section 3(a) will be retained for the duration of the Founder Edition initiative only. The Personal Data collected exclusively for the purpose of allowing you to participate to a specific initiative or event related to the Founder Edition will be retained for the time strictly necessary to manage and organize the initiative or event and will be promptly deleted by Bianchi after the conclusion of the same. 

Unless consent is withdrawn, if given, Data processed for the purpose under Section 3(b) will be retained for a maximum of 24 months from the date of collection.

6. Recipients or Categories of Recipients and Transfer Outside the European Economic Area (EEA)

Your Data will be processed by Bianchi personnel who are authorized under Article 29 of the GDPR.

It may also be communicated or made accessible to external parties such as Bianchi’s dealers, IT service providers, newsletter and survey form providers, event organization service providers or third parties involved in the organization and realization of events and initiatives, independent authorities, law enforcement or judicial and administrative authorities. Where necessary, Bianchi will appoint such parties as external data processors pursuant to Article 28 of the GDPR and/or provide you with additional details on such parties. A complete and up-to-date list of these recipients is available at the Controller’s registered office and may be requested at any time using the contact details provided in Section 1 of this notice.

Where necessary to achieve the purposes set out in Section 3, your Personal Data may be transferred outside the EEA in accordance with applicable law, particularly in compliance with the safeguards set out in the GDPR (e.g., standard contractual clauses, and appropriate technical, organizational and/or contractual measures) to ensure an adequate level of data protection equivalent to that within the EEA.

7. Your Rights

Subject to the conditions provided by the GDPR and applicable law, you may exercise your rights regarding the protection of your Personal Data at any time. These include: the right to access your Data, to have it rectified or deleted, to restrict or object to its processing, as well as the right to data portability.
You also have the right to withdraw your consent, if given, without affecting the lawfulness of processing based on consent before its withdrawal. Furthermore, you have the right to lodge a complaint with the competent data protection authority or to seek judicial remedy.
