F.I.V. E. Bianchi S.p.A. processes your personal data (hereinafter also referred to as “Data” or “Personal Data“) in compliance with EU Regulation 679/2016 (the “GDPR“) and any other law applicable to the protection of personal data, in accordance with the privacy policy set out below.

1) Personal Data Controller

The controller in respect of your Personal Data is F.I.V. E. Bianchi S.p.A., whose registered office is at Via delle Battaglie no. 5 – 24047 Treviglio (BG), tax code and Companies Registry registration no. 0022943016000229430160, VAT no. 01897810162, email: privacy@bianchi.com (hereinafter also “Bianchi” or the “Controller”).

2) Personal Data

Bianchi will process the Data that are strictly necessary to allow you to participate in bicycle show held in Riva del Garda (“BF“), both by manual and automatic means, in accordance with section 3 below. Specifically, Bianchi will process:

  • a) identification and contact data and signature, such as first and last name, email address, date and place of birth and signature and any other data contained in the identity card you provided in order to sign the bike terms of use and participate in the Bike test;
  • b) your identification data such as first and last name, email address included in the data processing consent form.

3) Purpose and legal basis of processing

Bianchi will process your Personal Data for the purposes and in compliance with the legal bases set out below:

  • a) to organise the BF and, in particular, to allow you to use the Bianchi bicycle while testing it (“Bike Test“), as well as to send you a copy of the signed documents and to process and follow up on any requests you may make to Bianchi, pursuant to the contractual legal basis under Art. 6(1)(b) of the GDPR;
  • b) sending information and commercial communications, newsletters and/or market research on Bianchi’s products and/or those of Bianchi’s business partners, via automated tools (e.g. email), without that data being shared with third parties, on the basis of your informed, free, unequivocal and specific consent pursuant to Art. 6(1)(a) of the GDPR;
  • c) to analyse and process information about you for the purpose of creating a profile of your preferences, habits, and consumption decisions, and thus offer you experiences and communications aligned with your interests, on the basis of your informed, free, unequivocal and specific consent under Art. 6(1)(a) of the GDPR;
  • d) to comply with any legal obligations and respond to requests from competent authorities (in this case, your Personal Data will be processed to comply with legal obligations to which Bianchi is subject, pursuant to Art. 6(1)(c) of the GDPR;
  • e) to protect Bianchi’s rights in and out of court, based on Bianchi’s legitimate interest in protecting its rights, pursuant to Art. 6(1)(f) of the GDPR.

4) Compulsory or optional nature of providing Data and consequences if not provided 

You must provide your Data for the purposes set out in subsections 3(a), (d) and (e): if you do not do so, you may not participate in the Bike Test.

Providing your Data for the purposes set out in subsections 3(b), (c) is optional. Please note that not providing your Personal Data will prevent Bianchi from using your Data for the purposes referred to in the subsections referred to above. In any event, we remind you that you may withdraw your consent at any time, without prejudice to the lawfulness of the processing based on the consent given before the withdrawal: specifically, you may withdraw your consent by using the unsubscribe link at the bottom of each communication and/or by writing to Bianchi at the contact details set out in this notice.

5) Personal Data storage period

Your Data will be kept for the period of time strictly necessary to achieve the purposes set out in section 3 above.

Specifically, Personal Data processed for the purposes set out in subsections 3(a), (d) and (e) will be kept for ten (10) years from the date on which they were collected, it being understood that, if a dispute arises, the Data will be processed for the entire duration of the dispute. 

Unless you withdraw your consent, if given:

  • (i) Data processed for the purpose referred to in subsection 3(b) will be processed for a maximum of 24 months from the date on which they are collected;
  • (ii) Data processed for the purpose referred to in subsection 3(c) will be kept for a period not exceeding one (1) year after being collected.

At the end of the storage period, your personal data will be deleted or anonymised. More detailed information on storage periods is available on request by contacting Bianchi at the contact details indicated in this notice.

Please note that your identity card will only be collected temporarily for the duration of the Bike Test and no copies will be made. Therefore, the Data contained therein will only be processed for that period.

6) Possible recipients or categories of recipients of Personal Data and transfer to countries outside the European Economic Area

Your Data will be processed by Bianchi staff, authorised pursuant to Art. 29 of the GDPR.

They may also be communicated and made accessible to external parties, such as consultants and lawyers, IT service providers, providers of newsletters and survey forms, providers of event organisation services, independent authorities, law enforcement agencies or judicial and administrative authorities. Where necessary, Bianchi will appoint such persons as external data processors, pursuant to Art. 28 of the GDPR. The complete and up-to-date list of the persons referred to above is available at the Controller’s registered office, to whom a copy may be requested at any time using the contact details set out in section 1 of this notice.

If it is necessary for the purposes set out in section 3 above, your Personal Data may be transferred outside the European Economic Area (“EEA“) in accordance with applicable law and, in particular, in accordance with the safeguards set out in the GDPR (e.g., standard contractual clauses and technical, organisational and/or contractual measures) that are appropriate to ensure an adequate level of data protection and, in any event, essentially equivalent to the level of data protection guaranteed within the EEA.

The list of countries outside the EEA to which Bianchi may transfer your Data is available upon request by contacting the Controller at the contact details indicated in this notice.

7) Your rights

If the conditions set out in the GDPR and applicable law are met, you may at any time exercise your recognised data protection rights, such as: the right to request access to your personal data, rectification or erasure of such data, restriction on processing data relating to you, the right to object to the processing, as well as the right to data portability; the right to revoke consent, if given, to processing based on consent, without prejudice to the processing carried out before withdrawal; the right to lodge a complaint with the competent privacy authority as well as to bring a legal claim.
